Requirements: 

It is necessary to have passed the exams in Private Law, Constitutional Law and International Law.

The methods of verifying learning consist of an oral exam with the assignment of the final mark out of thirty, concerning the entire program.

It is also foreseen, only for attending students, the possibility of carrying out, on a voluntary basis, 2 written tests of 2 open questions lasting 2 hours each, with attribution of the mark out of thirty.

The assessment of learning will take into account the accuracy and quality of the answers, the mastery in the use of an adequate technical-legal language as well as the ability to justify statements and opinions by arguing persuasively.

The course aims to explore the impact that new technologies have on public international law and on private and procedural international law.

At the end of the course the student will be able to:
- understand and analyze the legal issues related to cyber attacks and the use of remotely piloted aircraft in the fight against international terrorism;
- know and apply the European, international and internal rules on the determination of the competent judicial authority and on the law applicable to transnational disputes concerning the use of new technologies;
- autonomously develop a critical judgment on the jurisprudential and practical cases examined with reference to the legislation currently in force.

The course is divided into two modules.

The first module will focus on the use of drones in the fight against international terrorism, the cyber attacks suffered by states and the questions of identifying the competent judge, the applicable law and the circulation of decisions within the European judicial area in relation to international disputes concerning cryptocurrencies, blockchain, smart contracts and personal data protection.

The second module will instead focus on the determination of the competent court and the applicable law in the field of i) artificial intelligence, ii) infringement via the internet of personality rights, of the European Union legislation on the processing of personal data and of intellectual property rights , iii) online dissemination of disparaging remarks and iv) digital will.

In the last lesson of each module there is a general review of the topics covered in view of the exam.

Convenzionale

The teaching includes lectures with the use of power-point presentations as well as critical analysis and discussion, with the active participation of students, of jurisprudential and practical cases.

The course is held in the second semester. The teachers will receive the students by making an appointment at the end of the lesson or through the Microsoft Teams platform.
