Students must have passed the exams of Private Law, Constitutional Law and International Law.
Final exam is an oral discussion consisting of 2 questions with final mark expressed in thirtieth. The oral discussion relates to the whole program. Attending students will be able to take two written exams, one in the middle and one at the end of the course. The following will be evaluated: accuracy and quality of answers; use of appropriate technical-legal language; capacity of connecting the different topics covered during the course; critical and personal analysis of the current legal issues discussed in class.
The course aims to examine the most important international organisation (the United Nations, UN) and other forms of international cooperation between States. At the end of the course, students should be able to: - know and understand the main principles of international organisations, including the maintenance of international peace and security; - analyse the structure and functioning of the UN and other international organisations; - know and understand the various forms of international cooperation; - develop an indipendent critical judgement on current issues and apply the law of international organisations and cooperation to concrete cases.
Introduction - historical evolution of international organisations and the various forms of cooperation between States - notion and common characteristics of international organisations - criteria for classifying international organisations - soft law organisations - non-governmental organisations General part - international and domestic legal personality of international organisations - responsibility of international organisations for international wrongful acts: focus on the responsibility of the UN for the spread of cholera in Haiti and on the responsibility of the World Health Organisation in the management of the Covid-19 pandemic - immunities and privileges of international organisations - financing of international organisations Special part The UN Regional international organisations with a political and security vocation - NATO - Council of Europe Focus: the responses of the UN and other international organisations to the conflicts between Russia and Ukraine, Israel and Palestine and Israel and Iran Other forms of international cooperation between states - health cooperation - maritime cooperation - trade and financial cooperation - customs cooperation - judicial cooperation in civil and criminal matters, with a focus on the arrest warrants issued by the International Criminal Court against Putin and Netanyahu and on Italy's failure to arrest Almasri - cooperation on disarmament and arms control
The course takes place in the first semester and consists in 50 hours lessons. Teaching includes the critical analysis and discussion, with the active participation of students, of case-law and current issues.
