Passing the examination of private law institutions is required. General prerequisites are, therefore, knowledge of the institutions of private law and public law and a good use of the ordinary notions of elementary logic (deductive and inductive method).
The exam is oral and consists of an interview with the teacher during which you will be asked to demonstrate the learning of the concepts illustrated in lessons and the ability to orient yourself in the legal field regarding the relevant topics. The student will be asked some questions, one of which is notional and two more practical. Overall, the oral test lasts about 30 minutes.
The exam will also assess the capacity for argumentation and analytical rigor on the topics covered by the course, as well as the ownership of language and communication skills.
Instead of the oral exam, the attending students will be able to present a short written dissertation going into one of the topics exposed in class, which could then be the basis for a possible future degree thesis.
The course aims to provide basic knowledge of family law and people's law, in the light of recent legislative reforms and the rulings of the jurisprudence of merit and legitimacy that have largely redesigned its borders and institutions. The course is divided into a cycle of monothematic lessons whose topics are indicated below, with the aim of allowing learners who wish to be able to independently acquire a basic preliminary preparation for the purpose of a more profitable in-house learning.
The expected learning outcomes are the following:
- updated basic knowledge of family and personal law, with reference to personal and property aspects;
- ability to interpret the facts, retrain them in legal terms and find the tools to prepare the appropriate solution.
Attendance of the lessons is highly recommended, also because the alternation of teachers has been designed to provide students with a first approach to the problems that may arise for those who intend then to carry out traditional professions (lawyer, magistrate, notary). Moreover, it is not at all mandatory and a good level of preparation can also be obtained by studying the manual and consulting the materials that will be gradually uploaded to the e-learning platform.
In order to allow each student to prepare for the lessons or to select the topics of greatest interest, the schedule of lessons is made public in advance
For the preparation of the exam we suggest the study of T. AULETTA, Il diritto di famiglia (The family law), Giappichelli Editore, latest edition.
The teaching and regulatory materials used during the lessons will be made available on the e-learning platform.
