Essential is the knowledge of the substantive law implemented in the civil proceedings and civil procedural law I

If rectorial and departmental regulations and requirements permit the conduct of in-person examinations, mid-course students will be given the opportunity to take a written test on the first part of the syllabus

The course will focus on the special procedures contained in the IVth book of Civil Procedure Code. The aim is to make students acquire knowledge about the technical-legal rules of operation of the “monitorio” proceedings, the eviction proceedings, the provisional measures and the uniform procedure, the summary proceedings and hints with respect to the proceedings in the field of labour law.
The objective is therefore to identify the peculiarities of the so called “summary proceedings” in order to understand the distinction between the cognition typical of the same and the full and comprehensive one of the ordinary proceedings.
The second part of the course will aim to provide the main concepts and knowledge on the subject of forced and coercive enforcement.

In consistence with the formative objectives of the course, the same will begin with a deepening with respect to the “summary” in its various declinations in order to deal then with the monitorio proceedings, the eviction proceedings, the labour law proceedings,t he provisional measures and the uniform procedure, the summary proceedings as an alternative to the full cognition proceedings.

During the lecture the eventual chapters, the study of which could be omitted for the students attending the lectures will be identified.

Convenzionale

The course will be held in the second semester and will consist of 35 hours of lecturing.
