Good knowledge of international law, ecclesiastical law, canon law and religious comparative law, European Union law and public-constitutional law.
Oral exam on the Teams platform conducted according to the “inverted cone” method: a general question, followed by some more specific questions which in turn open up further study paths. The assessment of learning will take into account the accuracy and quality of the answers, the mastery in the use of technical-legal terminology as well as the ability to justify, arguing persuasively, the statements and opinions.
The course aims to provide future legal practitioners with the basic tools necessary for carrying out tasks aimed at the protection of human rights in a multicultural and multi-religious national and international context.
The first module of the course aims to provide the basis for the knowledge of the "human rights" protected by the international cooperation, with particular attention to the debate relating to their universality. This goal will be achieved both through the knowledge of the main international texts, their genesis and their contents (knowledge and understanding) and through the study of their "regional" reception with particular attention to the so-called Islamic model of human rights and the constant reference of the textual normative data to the cultural matrix that originated it (applying knowledge). The comparative framework will allow the acquisition of a reflective ability aimed at understanding social, political, cultural and religious conditions at the basis of the application of human rights as well as an attitude to a critical analysis of the situations examined (making judgments). Finally, also thanks to the final oral exam of the course, the student will prepare herself/himself for the communication of the main elements of the cases examined (communication) and for the personal reworking of the information received (learning skills).
The second module of the course will provide in-depth knowledge of the United Nations Agenda 20-30 with particular attention to the Euro-Mediterranean framework (knowledge and understanding) by exercising students to transfer general knowledge (applying knowledge) to the analysis of specific issues (ecological issue; women's rights; children's rights; right to education ...) by developing adequate assessment skills (making judgments) to be adequately argued and reworked also in view of the final interview (communication and learning skills).
The course is divided into two teaching modules of 25 hours each.
The first teaching module, aimed at providing the theoretical framework and basis of the course will illustrate: the genesis of human rights, their historical development, their "positivization" within the constitutionalism following the Second World War (with particular attention to their binding force and application mechanisms) and the debate on their regionalization and "universality", with special regard to the comparison with the Muslim "human rights" tradition.
The second teaching module, focusing on Agenda 20-30 as a global and transversal tool for the construction of peaceful, sustainable, inclusive and just societies, will focus on the factors that favor or limit its application in the Mediterranean area. In particular, different approaches to inclusion will be discussed; development actors (religious leadership, civil society, NgO); the role of local governance; sustainable cities and society models and sustainability of services (accessibility, capacity and quality); lifestyles and religious differences; the challenge of vulnerability.
